Terms of service

Effective Date: July 13, 2026


These Terms and Conditions (“Terms”) govern your access to and use of the PK Lighting website, your communications with PK Lighting, and any quote, estimate, installation, maintenance, support, or other service provided by PK Lighting.


Throughout these Terms, “PK Lighting,” “we,” “our,” and “us” refer to PK Lighting. “You” and “your” refer to the person accessing the website, requesting a quote, communicating with us, or purchasing or receiving our services.


By accessing our website, submitting a form, requesting a quote, agreeing to an estimate, or using our services, you acknowledge that you have read and agree to these Terms.


1. Our Services


PK Lighting provides professional lighting-related services, which may include:

  • Holiday lighting design and installation
  • Permanent exterior lighting installation
  • Lighting consultations and estimates
  • Lighting maintenance and support
  • Bulb or component replacement
  • Track reinstallation
  • Other related lighting services agreed to in writing


The specific products, services, project scope, pricing, timing, payment requirements, warranty coverage, and other project terms will be described in the applicable estimate, invoice, proposal, service agreement, or other written communication.


If a written estimate, proposal, invoice, or service agreement conflicts with these website Terms, the project-specific written agreement will control for that project.


2. Eligibility and Authority


You must be at least 18 years old and legally capable of entering into a binding agreement to request or purchase services from PK Lighting.


When requesting services for a property, you represent that you are the property owner or have authorization from the property owner to approve the requested work.


If you request services on behalf of a business, property owner, organization, homeowners association, or another person, you represent that you have the authority to act on that party’s behalf.


3. Quote and Estimate Requests


Information submitted through our website, telephone communications, text messages, emails, social media pages, or other inquiry methods may be used to prepare an initial quote or schedule an evaluation.


Unless expressly stated otherwise in writing:

  • Website information is provided for general informational purposes.
  • A quote request does not create a binding service agreement.
  • An initial verbal or online estimate may be subject to change following an onsite inspection.
  • Pricing may depend on property size, roofline, installation conditions, materials, electrical access, design preferences, product availability, labor requirements, and other project-specific factors.
  • A project is not confirmed until PK Lighting accepts it and any required agreement, approval, deposit, or payment has been completed.


Quotes and estimates may expire after the period stated in the applicable estimate. When no expiration period is stated, PK Lighting may revise pricing before the project is accepted.


4. Project Scope and Changes


The project scope will be based on the services, materials, locations, design, and installation specifications approved by the customer.


Requests to change the project after approval may result in:

  • Additional charges
  • Changes to the installation date
  • Additional labor or materials
  • A revised estimate or invoice
  • Changes to warranty coverage


PK Lighting is not required to perform work outside the agreed project scope unless the additional work is approved by both parties.


5. Customer Responsibilities


You agree to provide PK Lighting with accurate information regarding the property and requested services.


Before work begins, you are responsible for:

  • Providing safe and reasonable access to the property and work areas
  • Identifying known hazards, damaged areas, concealed utilities, irrigation systems, electrical issues, or structural concerns
  • Securing pets and maintaining a safe work environment
  • Removing vehicles, furniture, decorations, or other obstructions when requested
  • Obtaining any required approval from property owners, landlords, homeowners associations, municipalities, or other authorities
  • Confirming that electrical outlets, circuits, Wi-Fi systems, mobile devices, and other customer-provided systems are functional when required for the selected lighting system
  • Providing accurate contact and scheduling information


PK Lighting is not responsible for delays, added costs, or damage caused by inaccurate information, concealed conditions, unsafe property conditions, unauthorized work requests, or the customer’s failure to complete these responsibilities.


6. Property Access


You authorize PK Lighting and its personnel or service providers to enter the approved areas of the property at scheduled times to evaluate, install, inspect, maintain, repair, remove, or service lighting equipment.


You agree to disclose security systems, locked gates, access restrictions, pets, fragile property, or other conditions that could affect access or safety.


If reasonable access is not available at the scheduled time, the appointment may be delayed or rescheduled. Additional charges may apply when permitted by the applicable estimate or service agreement.


7. Scheduling and Delays


Installation and service dates are estimates unless PK Lighting expressly guarantees a date in writing.


Appointments may be affected by:

  • Severe weather
  • Unsafe roof or ladder conditions
  • Material or product availability
  • Shipping delays
  • Equipment failures
  • Property-access issues
  • Electrical problems
  • Illness or staffing limitations
  • Events outside PK Lighting’s reasonable control


PK Lighting will make reasonable efforts to communicate material scheduling changes but is not liable for delays caused by weather, suppliers, manufacturers, carriers, utility providers, government action, emergencies, or other circumstances outside our reasonable control.


8. Cancellations and Rescheduling


Cancellation, rescheduling, refund, and deposit terms may be stated in the applicable estimate, invoice, proposal, or service agreement.


You should contact PK Lighting as soon as possible when an appointment needs to be changed.


Custom-ordered products, specially purchased materials, completed design work, reserved labor, completed installation work, and nonrecoverable expenses may be nonrefundable to the extent permitted by law and the applicable project agreement.


Nothing in this section limits any cancellation or refund right that cannot legally be waived.


9. Payments


You agree to pay the amounts stated in the applicable estimate, invoice, proposal, or service agreement according to the listed payment schedule.


Unless otherwise agreed in writing:

  • Payments are due by the date shown on the invoice.
  • Deposits may be required before materials are ordered or installation is scheduled.
  • Work may be suspended when an amount is overdue.
  • Additional approved work may be invoiced separately.
  • Returned payments, chargebacks, or declined transactions may delay the project.
  • You remain responsible for valid charges associated with services, labor, and materials provided.


Any applicable taxes, permit costs, processing charges, or other disclosed fees may be added to the invoice.


10. Products and Materials


Product descriptions, photographs, demonstrations, renderings, and color examples are intended to provide a general representation of available lighting products and completed installations.


Actual appearance may differ because of:

  • Screen and display settings
  • Product revisions
  • Property design and surface materials
  • Installation location
  • Viewing distance
  • Ambient lighting
  • Manufacturer variations
  • Weather and environmental conditions


PK Lighting may use reasonably comparable materials or components when an originally selected product becomes unavailable, subject to customer approval when the substitution materially changes the project.


Manufacturer applications, controllers, Wi-Fi features, software, integrations, and third-party devices may be subject to separate manufacturer terms and may change independently of PK Lighting.


11. Installation Conditions and Property Damage


PK Lighting will use reasonable care while performing services. Lighting installation may require the use of ladders, clips, tracks, fasteners, adhesives, wiring, electrical connections, or other installation methods appropriate for the property and selected system.


Some minor marks, holes, surface changes, or ordinary installation effects may be unavoidable depending on the approved installation method.


PK Lighting is not responsible for preexisting damage, defective construction, rotted materials, loose surfaces, inadequate electrical systems, concealed defects, water intrusion, pest damage, or damage resulting from conditions that were not reasonably visible before work began.


You should promptly notify PK Lighting of any concern relating to completed work.


12. Permanent Lighting Warranty


Eligible permanent lighting installations may include a one-year warranty as described on the PK Lighting website or in the customer’s written project agreement.


Warranty services may include eligible bulb replacement, track reinstallation, and reasonable support during the applicable warranty period.


Warranty coverage does not apply to damage or failure caused by:

  • Misuse, abuse, negligence, or unauthorized alteration
  • Work performed by someone other than PK Lighting
  • Accidents, impact, vandalism, or animals
  • Severe weather, lightning, power surges, fire, flooding, or other events outside PK Lighting’s control
  • Defective customer electrical systems, Wi-Fi networks, mobile devices, or third-party equipment
  • Failure to follow product or maintenance instructions
  • Normal wear, fading, or cosmetic changes that do not affect functionality
  • Manufacturer discontinuation or unavailability of replacement products
  • Unpaid balances related to the installation


Manufacturer warranties may apply separately to individual products. When applicable, PK Lighting may assist the customer with a manufacturer-warranty request but does not control the manufacturer’s decision.


Any warranty terms stated in a signed project agreement will control over this general website section.


13. Website Use


You may use this website only for lawful personal or business purposes related to learning about PK Lighting, requesting information, or obtaining services.


You may not:

  • Attempt to gain unauthorized access to the website or connected systems
  • Interfere with the website’s security or operation
  • Submit false, fraudulent, misleading, or unlawful information
  • Use automated systems to scrape, copy, or overload the website
  • Upload malicious code or harmful materials
  • Impersonate another person or organization
  • Use website content in a way that violates intellectual-property rights
  • Use the website to engage in unlawful, abusive, harassing, or fraudulent activity


We may restrict access to the website when we reasonably believe these Terms have been violated.


14. Intellectual Property


The PK Lighting name, branding, logos, website design, photographs, graphics, written content, project images, videos, and other original materials are owned by or licensed to PK Lighting and are protected by applicable intellectual-property laws.


You may view the website and retain reasonable copies of estimates or service information for your personal use. You may not reproduce, publish, distribute, modify, sell, license, or commercially exploit our content without prior written permission.


Third-party product names, trademarks, applications, and logos belong to their respective owners. Reference to a third-party product does not imply ownership of that third-party brand.


15. Customer Photos and Project Media


PK Lighting may request permission to photograph or record completed work for documentation, quality control, portfolio use, website content, advertising, or social media.

We will not intentionally publish sensitive personal information with project images. Customers may notify PK Lighting in writing if they do not authorize public use of identifiable project photographs.


Any separate written photo or media authorization will control over this section.


16. Third-Party Websites and Services


Our website may contain links to third-party websites, applications, social media platforms, manufacturers, payment processors, or service providers.


PK Lighting does not control and is not responsible for the availability, security, content, privacy practices, products, or services of those third parties.


Your use of a third-party service may be governed by that provider’s separate terms and privacy policy.


17. PK Lighting SMS Messaging Program


Program Name and Description


The PK Lighting SMS Messaging Program provides text messages to individuals who have expressly opted in to receive them.

Informational messages may include:

  • Quote-request follow-ups
  • Appointment scheduling
  • Appointment confirmations and reminders
  • Installation updates
  • Project-related communication
  • Customer-service messages
  • Warranty or maintenance communication


Promotional messages may include:

  • Seasonal promotions
  • Special offers
  • Holiday-lighting information
  • Permanent-lighting information
  • Other PK Lighting marketing communications


Promotional messages are sent only when the recipient has provided the applicable consent.


Consent


By selecting an SMS consent checkbox, submitting an applicable opt-in form, or otherwise providing valid express consent, you authorize PK Lighting to send the selected categories of text messages to the mobile number you provide.


Consent to receive promotional text messages is not a condition of purchasing any product or service.


You represent that you are the subscriber or customary user of the mobile number provided and that you are authorized to provide consent for that number.


Message Frequency


Message frequency varies depending on your request, project activity, appointments, customer-service needs, and communication preferences.


Message and Data Rates


Message and data rates may apply to messages sent to you by PK Lighting and messages you send to PK Lighting. Contact your wireless carrier with questions about your mobile plan.


Opting Out


You may cancel SMS messages at any time by replying STOP to a message from PK Lighting.


After you send STOP, PK Lighting may send one final text message confirming that you have been unsubscribed. You will then no longer receive messages from that SMS program unless you provide new consent.


Other recognized opt-out keywords may also be honored where required by applicable messaging standards.


Rejoining the Program


After opting out, you may rejoin by completing the applicable SMS opt-in process again and providing renewed consent.


You may also contact PK Lighting for instructions on how to provide new consent.

Carrier Disclaimer


Wireless carriers are not liable for delayed or undelivered messages.

Message delivery may be affected by your mobile device, wireless coverage, carrier availability, blocked-number settings, system outages, or other circumstances outside PK Lighting’s control.


Supported Carriers and Devices


SMS service may not be available through every carrier or on every device. PK Lighting does not guarantee that all messages will be successfully delivered to every mobile number.


Privacy


Your use of the SMS program is also governed by our Privacy Policy. Mobile information and SMS consent will not be sold or provided to third parties or affiliates for their independent marketing or promotional purposes.


Service providers supporting message transmission may process information only as necessary to operate the messaging service, provide support, prevent fraud, maintain records, or comply with applicable law.


Messaging Compliance


PK Lighting intends to operate its messaging program in accordance with applicable law and recognized messaging-industry standards.


You agree not to use text communications with PK Lighting to transmit illegal, fraudulent, abusive, threatening, obscene, malicious, or harmful material.


18. Email and Electronic Communications


By submitting an email address or communicating with us electronically, you consent to receive project-related communications electronically.


Transactional or service-related emails may include quote information, appointment details, invoices, project updates, and customer-support messages.


You may unsubscribe from promotional emails using the unsubscribe option included in the message. Unsubscribing from marketing emails does not prevent necessary transactional or service-related communications.


19. Privacy


Our collection and use of personal information are governed by the PK Lighting Privacy Policy, which is incorporated into these Terms by reference.


Please review the Privacy Policy before submitting personal information through the website.


20. Disclaimer of Warranties


Except for any express written warranty provided by PK Lighting, the website and its content are provided on an “as is” and “as available” basis.


To the fullest extent permitted by law, PK Lighting disclaims implied warranties relating to the website, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.


PK Lighting does not warrant that:

  • The website will always be available or error-free
  • Website information will always be complete or current
  • Third-party applications or products will remain compatible
  • Wireless, Wi-Fi, mobile, or manufacturer systems will operate without interruption
  • Lighting products will appear identical under all conditions


This section does not disclaim an express written project warranty or any warranty that cannot legally be excluded.


21. Limitation of Liability


To the fullest extent permitted by applicable law, PK Lighting will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost opportunities, loss of data, loss of use, or business interruption arising from the website, communications, products, or services.


PK Lighting’s total liability arising from a particular project will not exceed the amount the customer paid to PK Lighting for the specific products or services giving rise to the claim, except where a different limitation is required by law or agreed in writing.


These limitations do not apply to liability that cannot legally be limited or excluded.


22. Indemnification


To the extent permitted by law, you agree to indemnify and hold PK Lighting harmless from claims, damages, losses, liabilities, and reasonable expenses arising from:

  • Your unlawful or unauthorized use of the website
  • False or inaccurate information you provide
  • Your violation of these Terms
  • Your violation of another person’s rights
  • Work you requested without required ownership or property authorization
  • Unsafe or concealed property conditions you knew about but did not disclose


This section does not require you to indemnify PK Lighting for liability caused solely by PK Lighting’s own unlawful conduct or gross negligence where such indemnification is prohibited.


23. Governing Law and Venue


These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.


Any legal action arising from these Terms or the use of the website must be brought in a court with proper jurisdiction in Dallas County, Texas, unless applicable law requires another location.

Before filing a legal action, the parties are encouraged to make a good-faith effort to resolve the issue directly.


24. Severability


If any provision of these Terms is found invalid or unenforceable, that provision will be modified or limited to the minimum extent necessary, and the remaining provisions will continue in effect.


25. No Waiver


A failure by PK Lighting to enforce any provision of these Terms does not waive its right to enforce that provision or any other provision later.


26. Entire Agreement


These Terms, the Privacy Policy, and any applicable estimate, proposal, invoice, warranty, or service agreement constitute the agreement between you and PK Lighting regarding the applicable website use or services.


Project-specific written agreements may include additional terms.


27. Changes to These Terms


PK Lighting may update these Terms to reflect changes in our services, website, business practices, technology, messaging program, or legal requirements.


The revised Terms will be posted with an updated effective date. Changes apply prospectively from the date they are published unless otherwise required by law.
